Based on the results of examination of the State Securities Commission (SSC) and the results of verification by the police, Mr. Nguyen Minh Tuan (Address: Tru 1 Civil group, Co Nhue 2, Bac Tu Liem District, Hanoi) conducted the manipulation of shares of the Halcom JSC (Securities code: HID), violating the regulations as prescribed in clause 4, Article 9 of the Securities Law and point a, clause 2, Article 70 of the Decree No. 58/2012/ND-CP dated 20 July 2012 of the Government stipulating in detail and guiding the implementation of a number of articles of the Securities Law and the law amending and supplementing a number of articles of Securities Law, as follow: Mr. Nguyen Minh Tuan used his 02 accounts and 36 accounts in the name of others opened at 08 securities companies to continuously buy, sell, create artificial supply and demand, manipulate HID shares from 01 August 2016 to 30 March 2017.
Based on the results of verification by the police, the consequences caused by the manipulation of HID shares of Mr. Nguyen Minh Tuan is not serious enough to be examined for criminal liability in accordance with Article 181C - Penal Code 1999, supplemented and amended in 2009. On 31 August 2018, the State Securities Commission (SSC) issued Decision No. 723/QD-XPVPHC on administrative sanction for violations of Mr. Nguyen Minh Tuan, as follows:
A fine of 550,000,000 (Fifty-five million VND) as prescribed in point b, clause 1, Article 3, clause 3, Article 29 of the Decree No. 108/2013/ND-CP dated 23 September 2013 of the Government stipulating on administrative sanctions in the field of securities and the securities market (Decree No. 108/2013/ND-CP), amended and supplemented in clause 36, Article 1 of the Decree No. 145/2016/ND-CP dated 01 November 2016 of the Government on amendments to the Decree No. 108/2013/ND-CP.
Based on the results of the examination and the documents, the calculation of the illegal gain from the violation, there is no illegal gain from Mr. Nguyen Minh Tuan's violation.
The Decision took effect from the date of 31 August 2018.
